TERMS OF SERVICE

These terms apply to all bookings, courses and services provided by Sea State Co (operated by Jordan Black, ABN 27393923968). By booking a course through this website, you agree to these terms.

1. Bookings and payment

  • Your spot is confirmed once full payment has been received.
  • Prices are in Australian dollars and include GST where applicable.
  • Course details, including the exact meeting location, will be emailed to you before the course.
  • Our Cancellation and Refund Policy applies to all bookings and forms part of these terms.

2. Participant requirements
To take part, you must:

  • Be 16 years or older. Participants under 18 need written consent from a parent or guardian.
  • Be a confident swimmer and comfortable in open water.
  • Hold a valid NSW Recreational Fishing Licence for any spearfishing activity.
  • Complete and sign our participant waiver and health declaration before the course.
  • Tell us about any medical condition, injury or medication that could affect your safety in the water.

3. Risks
Spearfishing and freediving are adventure activities with inherent risks. These include drowning, shallow water blackout, injury from equipment, marine life (including sharks), boat traffic, and changing weather and sea conditions. We take every reasonable step to manage these risks, but they can’t be removed entirely. By taking part, you accept these risks.

4. Safety and conduct

  • You must follow your instructor’s directions at all times.
  • Your instructor may change, shorten or stop any part of the course if conditions or safety require it.
  • We may remove anyone from the course who behaves unsafely, ignores directions, or appears affected by alcohol or drugs. No refund applies in this case.

6. Photos and video
We may take photos or video during courses for use on our website and social media. If you’d rather not appear, let your instructor know on the day or email us.

7. Limitation of liability
To the extent permitted by law, Sea State Co is not liable for any injury, loss or damage arising from your participation, except where caused by our negligence. Our total liability for any claim relating to a booking is limited to the course fee you paid. We are not responsible for travel, accommodation or other costs you incur.

Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law that cannot be excluded.

8. Privacy
Your personal information is handled in line with our Privacy Policy.

9. Changes to these terms
We may update these terms from time to time. The version on this page at the time of your booking applies.

10. Governing law
These terms are governed by the laws of New South Wales, Australia.
